Introduction

These terms and conditions set out the contractual agreement between Trainbee and the users of our website, whether they are trainees seeking clinical placements or recruiters providing job opportunities in the therapy sector.

We reserve the right to amend these terms at any time and will notify users of any significant changes by email

About Trainbee

Our Service and Role 

Our website provides a platform for trainees seeking clinical placements and recruiters offering job opportunities in the therapy sector to connect. Recruiters can create a profile page that is searchable by trainees.

Trainbee’s role is to facilitate these connections by providing the platform, but we are not responsible for overseeing or regulating the subsequent employment contract between trainees and recruiters.

Trainbee offers an optional verification process for recruiters to provide their organization’s details and complete an “ethical practice” form. However, we do not run background checks on users, and we cannot take responsibility for the accuracy or completeness of information that users provide about themselves.

User Responsibilities

Users must keep their account password safe and not share it with anyone else. If they suspect that someone else knows their password, they must change it immediately. Users are solely responsible for all actions taken on our website using their account.

Users must provide accurate and up-to-date information about themselves and may not create an account using an assumed name or someone else’s identity.

Users must not engage in abusive or discriminatory behaviour towards other users, mislead them, or make promises they do not intend to keep. Trainbee reserves the right to terminate or suspend user accounts immediately in response to complaints about their conduct towards other users.

Users must keep any confidential information shared with them by other users in the context of the service confidential, unless they are required to disclose it by law. Users must not post any confidential information in any area of the service that is visible to other users.

 Uploading Content to Trainbee

Users may upload various materials, including text, images, and video, to our website. However, they must ensure that they have all the necessary rights to use and share that material with us and other users and that it does not contain any trade secrets, confidential information, or unlawful, offensive, obscene, or defamatory content.

Users retain ownership rights in their content but must grant Trainbee and other users a limited license to use, store, copy, distribute, and make it available to third parties.

Trainbee has the right to disclose the user’s identity to any third party claiming a violation of their intellectual property rights or right to privacy.

Trainbee is not responsible or liable for any content posted by users.

Trainbee has the right to remove any posting made on the website.

The views expressed by other users on the website do not represent Trainbee’s views or values.

Your Content License

When you upload or post content to our Service, you grant Trainbee a perpetual, worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your content in connection with the Service. This license includes the right to promote the Service and transfer the license to third parties. Additionally, you grant all Users of the Service a worldwide, non-exclusive, royalty-free license to use your content for their purposes in connection with the Service, which terminates upon the deletion of your content.

 Trainbee’s Intellectual Property Rights

Trainbee owns or is licensed to use the intellectual property rights in the Service, including branding, trademarks, and underlying technologies. Trainbee grants you a non-exclusive, revocable, royalty-free, non-sublicensable license to use the Service in accordance with these Terms. Trainbee may revoke your license to use the Service at any time, at which point you agree to remove any derivative data from any device under your control.

 Your Responsibilities as a Trainee

Trainbee’s Service is free for Trainees. If you wish to terminate your account with us, you can do so via the Service or email us at admin@trainbee.co.uk and we will do so.

 When you create your account with Trainbee as a Trainee, we may ask you to provide us with your full CV or with relevant information about your experience, specialisms, course information, skills, a short summary about your interests, and a short summary about your aspirations, your work experience, and your education, photograph, location and interests. That information can be viewed by Recruiters, and we use it to match you with potential Placements and to give you the chance to apply to perform those roles, so you must ensure that the information you give to us is accurate and current, and you must keep it up to date. 

You must not apply for a Placement unless, based on the information which the Recruiter has provided, you are reasonably satisfied that you have the relevant skills and qualifications for the role. Additionally, you must not provide any false or misleading information when applying for a Placement or when creating your Trainee account.

You must not offer to perform, or describe yourself as able to perform, any service or task which is unlawful.

 As a Recruiter (Agency), it is important to understand your responsibilities when using Trainbee’s Service. Below are the key terms and conditions that you must adhere to:

Account Usage

By creating an account as a Recruiter, you confirm that you will use the Service solely for business purposes. Each time you use the Service, you represent to us that you are using it in the course of your business or profession. If this representation is, or becomes, untrue, we reserve the right to terminate your account immediately.

Compliance with Regulations

If you are an employment agency or business, you are responsible for complying with the Conduct of Employment Agencies and Employment Businesses Regulations 2003 and all other applicable laws in relation to your placement posts, communications with Trainees, and management of Trainees’ details.

Lawful Placement Posts

You must not post any placement that would (in whole or in part) be unlawful to perform.

One Placement Per Post

A Placement post may not contain more than one type of placement position or placement description. 

Equal Opportunities and Discrimination

All placement posts must comply with laws protecting equal opportunities and preventing discrimination.

Trainbee’s Rights

We reserve the right to remove any placement listing or advertisement that you post in breach of these terms, and to charge you for any additional placement posted in breach of regulations.

Indemnity

You shall indemnify us against any third-party claims arising from your failure to comply with laws protecting equal opportunities and preventing discrimination.

Fees

Details of our fees payable in return for our Service can be found on your dashboard under ‘submit placement’. Our fees quoted are exclusive of VAT, and we will add it to our fees if it is payable.

Payment

If fees are not charged upfront, payment of invoices is due within 30 days from the date of the invoice.

 Account Suspension

If an invoice remains outstanding for more than seven days, we reserve the right to suspend your account until full settlement is received. During the period in which your account is suspended, any Placements posted by you will be removed from the Service. For the avoidance of doubt, you shall remain liable for all payments due despite such suspension.

 Late Payment

Without prejudice to any other remedy, we reserve the right to charge interest on any outstanding or late payments and to recover our reasonable costs for recovering such debt, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998 as amended.

Debt Collection Costs

Without limiting our rights under clause 11, you agree to reimburse us on demand the full costs incurred by us (including legal costs, administrative costs, and costs incurred in instructing a debt collection agency) in the recovery of any unpaid sums due under these terms.

Account Termination

If you wish to terminate your account with us, please do this via the Service or email us at support@trainbee.co.uk, and your account will be terminated at the end of your then current subscription period.

Refunds

We do not offer refunds of any payments already received by us.

 Discounts and Promotion Offers

 Honouring Offers

We may offer discounts or other promotional offers from time to time. We reserve the right to not honour such discount or promotional offer for any reason, including but not limited to fraud or mistake.

User-Specific Offers

We may advertise offers available only to specific users.

Offer Pricing

The price advertised in our offers reflects the discount applied to one or several of our advertising products.

Trainbee’s Rights

Trainbee reserves the right to remove or modify any offer listed at any time.

Your privacy

At our Service, we understand the importance of your privacy and are committed to processing your personal data in accordance with applicable data protection laws and our Privacy Policy. By using our Service, you agree to the processing of your personal data as described in our Privacy Policy. We encourage you to carefully read our Privacy Policy to understand how we collect, use, and protect your personal data.

No Reliance on Information:

The content available on our Service is provided for general information purposes only and should not be relied upon as advice. We make reasonable efforts to ensure that the information available on our Service is accurate, complete, and up-to-date, but we make no representations, warranties, or guarantees, whether express or implied, regarding the accuracy, completeness, or currency of the content. It is your responsibility to verify the accuracy and completeness of any information provided on our Service before relying on it.

Our Rights and Responsibilities as Service Providers

As the service providers of this platform, we will make reasonable efforts to keep the technology powering the Service operational and ensure the service is performed with reasonable skill and care. However, we offer no other warranty for the Service, and all warranties implied into these terms by law are excluded to the fullest extent permitted.

We may add or remove features from the Service as required, and we will notify users of any significant changes that may affect how they use the platform.

Responsibilities of Users

Trainees and Recruiters are responsible for the acceptance and performance of jobs and placement practices, respectively. If disputes arise between users, we may offer assistance to resolve the matter, but we are under no obligation to achieve a compromise or resolution. Users remain responsible for resolving disputes according to the contract between them.

Liability

We are not liable for any loss or damage that may arise from the use of the Service or reliance on any content displayed on our Service, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable.

We exclude all conditions, warranties, representations, or other terms which may apply to our Service or any content on it, whether express or implied, to the extent permitted by law.

In particular, we will not be liable for any indirect or consequential loss or damage, loss of profits, sales, business or revenue, business interruption, loss of anticipated savings, loss of business opportunity, goodwill, or reputation.

However, nothing in these terms excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

If you are a consumer, please note that we only provide our Service for domestic and private use, and we have no liability for any loss of profit, loss of business, business interruption, or loss of business opportunity resulting from the use of our Service for commercial or business purposes.

If you are a business, our liability to you arising under or in connection with these terms or the Service is limited to an amount equal to the total fees you have paid to us in the 12 months preceding the event (or last in the series of events) giving rise to such liability.

Account Suspension and Termination

We reserve the right to suspend or terminate your account immediately if you breach these terms, or we reasonably believe it is necessary to protect our interests or those of other users, or if you become bankrupt or insolvent, or if you die or otherwise become incapable of performing your obligations under these terms.

Virus and Technological Harmful Material

We are not liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our Service or to your downloading of any content on it, or on any website linked to it.

Linked Websites

We assume no responsibility for the content of websites linked on our Service, and such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them.

Important Terms to Note for Our Service Agreement

Entire Agreement

These terms and any associated documents represent the entirety of the agreement between you and us pertaining to the use of our Service.

Legal Effect of Representations

No pre-contractual statements or representations will hold any legal effect unless they are explicitly stated in these terms.

Contractual Relationship

These terms outline the contract under which we provide you with access to our Service. No partnership, agency, or employment relationship is created by these terms.

Validity of Waivers

We will not consider any waivers of these terms to be valid unless they are agreed to in writing.

Force Majeure

Neither party will be held liable for any failure to perform their obligations under these terms in the event of reasons beyond their reasonable control.

Governing Law and Jurisdiction

These terms and any non-contractual obligations arising from them are subject to English law and the exclusive jurisdiction of English courts
